FormHug (“FormHug”, “we”, “us”, or “our”) provides an online form-building platform accessible via https://formhug.ai (the “Site”) and related services, features, content, and applications (collectively, the “Service”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and FormHug governing your access to and use of the Service. By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. You represent and warrant that you have the legal capacity and authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.2. Definitions

| Form Creator | A User who creates and publishes Forms using the Service. |
| Submitter | An individual who fills out and submits a Form created by a Form Creator. |
| Submission | The data and responses collected when a Submitter completes a Form. |
| User Content | All content, including Forms, Submissions, and other materials, that Users create, upload, or collect through the Service. |
| Intellectual Property Rights | All patents, copyrights, trademarks, trade secrets, and other proprietary rights. |
3. Description of the Service
FormHug provides a web-based platform that enables Users to create, customize, publish, and manage online Forms. The Service includes a variety of features for form design, data collection, workflow automation, and integration with third-party applications. We reserve the right to modify, suspend, or discontinue the Service, or any part thereof, at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.4. Account Registration and Security
4.1 Account Creation
To access certain features of the Service, you must register for an Account. You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to create an Account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.4.2 Account Security
You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account or any other breach of security. FormHug will not be liable for any loss or damage arising from your failure to protect your Account credentials.4.3 Account Restrictions
Each individual User must maintain a unique Account. Sharing Account credentials is prohibited. We reserve the right to suspend or terminate your Account if any information provided proves to be inaccurate, not current, or incomplete.5. User Conduct and Prohibited Activities
5.1 Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct and all User Content you create or collect through the Service.5.2 Prohibited Activities
You agree not to engage in any of the following prohibited activities:- Using the Service for any illegal or fraudulent purpose, or in violation of any applicable law or regulation.
- Collecting, using, or disclosing personal information without proper consent or in violation of applicable data protection laws.
- Infringing upon the Intellectual Property Rights or other rights of any third party.
- Transmitting any content that is harmful, defamatory, obscene, abusive, or otherwise objectionable.
- Distributing viruses, malware, or any other malicious code.
- Attempting to gain unauthorized access to the Service, other Accounts, or any related systems or networks.
- Interfering with or disrupting the integrity or performance of the Service.
- Reverse engineering, decompiling, or disassembling any part of the Service.
- Using the Service to send unsolicited or unauthorized advertising, spam, or promotional materials.
- Using the Service for purposes of competitive analysis or to develop a competing product or service.
- Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
6. License and Intellectual Property
6.1 License to Users
Subject to your compliance with these Terms, FormHug grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal business or personal purposes.6.2 FormHug Intellectual Property
The Service, including all associated Intellectual Property Rights, is and shall remain the exclusive property of FormHug and its licensors. These Terms do not grant you any right, title, or interest in the Service, except for the limited license granted above. All rights not expressly granted are reserved by FormHug.6.3 License to User Content
You retain all ownership rights in your User Content. By submitting User Content to the Service, you grant FormHug a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, and distribute such User Content solely for the purpose of providing and improving the Service.6.4 Feedback
If you provide any suggestions, comments, or feedback regarding the Service (“Feedback”), you grant FormHug a perpetual, irrevocable, worldwide, royalty-free license to use such Feedback for any purpose without any obligation to you.7. Fees and Payment
7.1 Subscription Plans
Certain features of the Service may require payment of fees (“Fees”). Information regarding pricing is available on our website. We encourage you to review our pricing page for the most up-to-date information.7.2 Billing and Payment
If you subscribe to a paid plan, you authorize FormHug or its third-party payment processors to charge the applicable Fees to your designated payment method on a recurring basis (monthly or annually) in advance. You are responsible for providing accurate and current payment information.7.3 Price Changes
FormHug reserves the right to modify the Fees at any time. We will provide you with at least thirty (30) days’ notice before any price changes take effect. Your continued use of the Service after the price change becomes effective constitutes your acceptance of the new Fees.7.4 Refunds
All Fees are non-refundable, except as expressly stated in these Terms or as required by applicable law.8. Data Protection and Privacy
8.1 Privacy Policy
Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you agree to the terms of our Privacy Policy.8.2 Data Processing
When you use the Service to collect personal data from Submitters, you act as the data controller, and FormHug acts as the data processor on your behalf. You are responsible for ensuring that you have a lawful basis for collecting and processing such data and for complying with all applicable data protection laws.8.3 Data Security
FormHug implements administrative, physical, and technical safeguards to protect the security, confidentiality, and integrity of personal data. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.9. Third-Party Services and Integrations
The Service may integrate with or contain links to third-party websites, applications, or services (“Third-Party Services”). FormHug does not control and is not responsible for the content, privacy policies, or practices of any Third-Party Services. Your use of Third-Party Services is at your own risk and subject to the terms and conditions of those services.10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FORMHUG DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FORMHUG DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME ALL RISK FOR ANY DAMAGE THAT MAY RESULT FROM YOUR USE OF THE SERVICE.11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FORMHUG, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:- Your access to or use of, or inability to access or use, the Service.
- Any conduct or content of any third party on the Service.
- Any User Content obtained from the Service.
- Unauthorized access, use, or alteration of your transmissions or content.
12. Indemnification
You agree to indemnify, defend, and hold harmless FormHug and its affiliates, directors, officers, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:- Your use of the Service.
- Your User Content.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Your violation of any applicable law or regulation.
